Federal Court Cases that Could Affect RPSs

This webinar examined the implications of recent and pending federal legal cases, including the nuclear zero emission credit cases in Illinois and New York, and the Allco cases in Connecticut. Among other topics, the session considered the prospects for challenges to RPSs based on the Commerce Clause of the Constitution. Guest speaker Harvey Reiter led attendees on a tour of the relevant cases and the issues they raise for RPSs. Mr. Reiter is a Partner at Stinson Leonard Street LLP and teaches Regulated Industries at George Washington University Law School. He has written law review articles on the Commerce Clause and is Executive Editor of the Energy Law Journal. Mr. Reiter’s presentation was followed by a Q&A with the audience.
